Human Rights Watch
Human Rights Watch International Film Festival Living amidst New York City’s many cultures and crazy festivals and celebratory events, we tend to forget that there is a vast world beyond the city borders. Fortunately enough, the city also gives opportunities to see and learn more about the world beyond the five boroughs. The 13th annual Human Rights Watch (HRW) International Film Festival is here in New York from June 15-28th. The Human Rights Watch Organization tracks developments in more than 70 countries around the world. They follow issues in women's rights, children's rights, and the flow of arms to abusive forces. Other special projects include academic freedom, the human rights responsibilities of corporations, international justice, prisons, drugs, and refugees. The list goes on, seemingly in correlation with some of the cruelties we all too often find in human nature. Recognizing the power of film to educate and incite citizens, HRW created the Human Rights Watch International Film Festival where they showcase the heroic stories of activists and survivors from all over the world. The works featured help “put a human face on threats to individual freedom and dignity, and celebrate the power of the human spirit and intellect to prevail.” This year, HRW presents twenty-four films and videos from nineteen countries. The films represent differing issues faced by the world today. Some are well-known and popular, such as the topic of global warming and the environment in “Everything’s Cool” by Daniel B. Gold and Judith Helfand and “Manufactured Landscapes” by Jennifer Baichwal. Some films also include the most controversial topics of genocide in Darfur and the Israeli-Palestinian conflict in “The Devil Came on Horseback” by Annie Sundberg and Ricki Stern and “Hot House” by Shimon Dotan. The unique benefit of attending some of the films’ showings is the discussion with the filmmaker to follow. The Q&A sessions are fantastic and brilliant chances for the audience to better understand on a deeper level the messages in the film with the actual visionaries. On June 17th, I attended the New York premiere of “Enemies of Happiness” by Eva Mulvad, 2007 Nestor Almendros Prize winner for courage in filmmaking. The film follows the personal courage and conviction of the most famous and infamous Afghani woman, Malalai Joya, who ran in her country’s first democratic parliamentary election back in 2005 at the age of 28. Joya is an advocate for women’s rights and voice of “freedom loving democracy” for the country’s citizens challenging the power of warlords in a new government. There are moments in the film that are so raw and naked, no words are spoken in order to show just how vulnerable humans can be. The audience applauded as Eva Mulvad and Malalai Joya stepped on stage after the viewing. Malalai Joya undoubtedly has passion and sincerity in her voice as she tackles the controversial issues faced by her people and her nation. We all know there are stories well beyond our own and unfortunately, we tend to forget that. People all over the world go through the same emotions, we all cry when we’re sad and we all smile and laugh when we’re happy, but we all have our own struggles and challenges faced each day. The positive light of the film festival is we can all learn from each other. Human Rights Watch International Film Festival provides a chance to see beyond our borders. “We seek to empower everyone with the knowledge that personal commitment can make a very real difference.” - HRW All films are screened at: Walter Reade Theater at Lincoln Center 165 W. 65th St., plaza level (between Broadway and Amsterdam Ave.) General admission is $11, $7 for Film Society members $7 for full-time students with valid photo ID For more information, go to www.hrw.org/iff/ For short documentaries viewings from home, go to www.mediathatmattersfest.org Tips On Selecting A Lawyer
Unlike a few aeons ago these days one lawyer does not handle all legal aspects. It’s the era of specialists and lawyers too have diversified to exclusively deal with some specific aspects of law. So, what you must do when the need for legal counsel arises is to hire a lawyer who is an expert on what you need. Lawyers must be hired based on their experience and qualifications and not on their age, good looks, charm, nice office, or polite receptionist. To select the ideal lawyer you must: 1. Make a thorough survey. Surf the net, look at yellow pages, ask the Bar Association for suggestions. Then make a short list of lawyers who may fit the bill. 2. Check each lawyer completely. Get references and check them out. Find out how long the lawyer has been in practice, the number of cases handled in the field you require, and the success rate. 3. Determine what each lawyer charges and his way of functioning. You do not want a lawyer who will take the file and hand it over to a junior. You need a lawyer who will handle the case himself. 4. Meet with the lawyer and go prepared with a file on your case and a list of relevant questions which will help you decide on whether the lawyer is perfect 5. Check with all local bar associations to check whether the lawyer you are considering has a good reputation and whether there are any complaints against him. 6. Find out whether the lawyer is a member of local, state, or national associations. The World Wide Web is a good source of information. 7. Check the lawyer’s bio-data carefully and read through any brochures the firm may have. 8. Weigh the pros and cons of hiring a large firm versus small firm or lawyer practicing alone. 9. Determine how much experience the lawyer has in cases like yours and his extent of knowledge and expertise. He must be able to take the required action without having to “think about it.” Take a moment to mull on what kind of legal service you require and whether it will be one-time or repetitive. And, whether or not you will get along with the lawyer you choose. For effective handling of legal files the lawyer-client synchrony is crucial and there must be a bond and understanding between the two for the relationship to work. An ideal lawyer cannot be located overnight. It may take several days of your time and effort. But it will be well worth it if you manage to find the perfect one to handle your case. Your Consumer Rights. Consumer credit reporting agencies (CRAs) collect credit information on you from banks, department stores, credit card companies, and other types of financial institutions that may extend you credit. CRAs make money selling the information they have in their databank, including information about your credit profile. Because of this, it is only prudent that you exercise your legal rights as a consumer, know what is in your credit file, make sure they are accurate and challenge it and have it corrected when necessary. CRAs are required by the Fair Credit Reporting Act to tell you the contents of your file. There are several ways to contact a CRA: IF DECLINED FOR A LOAN, call the lender who is required by the FCRA to give you the name, address and phone number of the CRA it used in evaluating your loan application. IF YOU'RE JUST CURIOUS, you can find out the contents of your file by calling the CRA nearest you. They are usually listed in the phone book under Credit Reporting Agencies. If your report contains inaccurate information, you may challenge the inclusion of it in your file. One option: If a lender has made an error, point it out to the lender and request that corrected information be sent to the CRA. These are your Consumer Rights.. Author: G.wadel Gov. In life perhaps the most difficult task is that of dealing with the payment or fees due to a lawyer. Today for many aspects of existence a lawyer becomes essential and sadly a large number of disagreements between lawyers and clients arise over fees. It is important that you discuss with your lawyer at the very beginning that you would appreciate receiving a detailed bill that includes: date of service; time spent; amount charged; expenses incurred; advances received; the total amount due on the case; and the period of time covered by the bill. If you and the lawyer reach an understanding that is clear right from day 1 then your relationship will proceed well and not sour. Fees to be paid to a lawyer can include: contingency fee; a flat fee; statutory fee; and the hourly fee. While you could try and negotiate a flat fee for a service, most lawyers prefer to charge by the hour and the rate could be as much as USD 125- USD 200 an hour. Therefore if you speak with the lawyer on the phone on everything other than matters on hand you will be paying dearly for every minute. To get the best out of the situation you need to: 1. Find out what the “going” rates are not just in the firm but in the market. Check with associations as well as on the internet. If you get facts down accurately you will be able to discuss billing with the lawyer intelligently. 2. In case you need a lawyer to handle more than one legal case or work then talk about a blended rate which will be neither too high or low, a midpoint between the firms highest and lowest rate. 3. Find out if fees will be reduced if you undertake to do some of the work on the case yourself. Most law offices are busy and gladly offer lower rates if a client will do some of the running around and research or locating witnesses themselves. 4. Ask if the lawyer and his firm have in place any discount policy. Many firms offer discounts on billing between 10-15% for immediate settlement of bills, advance payments or for sustained assignments. Unless you ask such information will not be disclosed. 5. Many lawyers will bill less if you prepare drafts of documents and a file with all relevant papers yourself. This saves the lawyer and his staff a lot of time. So ask about the possibility of lower billing if you undertake to do a lot of the work yourself. 6. For representation at court request to be billed at a flat rate and not on an hourly basis. This way you will not be paying hourly for the number of hours a lawyer is forced to “hang around” court because of umpteen reasons. 7. Since lawyers generally bill for time taken to travel on your work negotiate a discounted billing rate for travel time, many lawyers agree to bill at 50% or less. 8. Determine how much you can afford in terms of legal fees. Cases can drag on and you may go bankrupt trying to fight a case which does not deserve so much attention. Be frank with the lawyer and ask him to advise you on whether the case is worth fighting and what the chances are of winning. Indicate how much you can really afford. 9. For some cases, lawyers agree to work for a percentage of what the “court awards as damages.” If your case is strong then a lawyer would be more than willing to work for contingency fees. 10. Find out if the lawyer would agree to a lower hourly rate if you give a higher retainer fee. This way you will save money as billing on an hourly basis can run into high amounts especially if you are nor organized and waste a considerable amount of the lawyer’s time. Be clear from day one as far as fees are concerned. Ask about charges, negotiate well and put down what you agree upon in writing. Both you and the lawyer must sign the contract. Step #8: Educate your audience with written information and advice. Write your marketing message in a form that you can send to anyone who calls your office. Then, by offering to send copies without charge, you attract calls from genuine prospects. When prospects call, they give you their names and addresses (or e-mail addresses). Then you add these prospective clients to your in-house mailing list. Important Note: The longer your materials, the better. The longer you keep your prospect's attention -- and the more facts you provide -- the more likely your prospect is to hire your services. Fortunately, prospects will read long materials, provided they are well written and relevant to their problem. The fact kit I used for 15 years varied from 40 to 50 pages in length. And many lawyers (my prospective clients) told me they read every word. I have now included all this information on my web site and in the article packet I send by e-mail, so I no longer use a printed fact kit. Step #9: Define the geographical area from which you want to draw clients. Geographics identify individual prospects by where they live, where they work, and where you can find the prospective clients you want. Geographics identify companies by where they are based, where they have facilities and where they do business. Step #10: Compile a media list of newspapers, magazines, newsletters and other media you want to receive your news releases and query letters. Your articles will appear in national, regional and local publications in all the states where you hope to serve clients. You can usually find current media lists online and at the library reference desk. Step #11: Launch an aggressive publicity campaign by sending news releases, feature articles and query letters to your entire media list. If you send articles 4 or 5 times each year, you could have an ongoing flow of articles appearing in various parts of the country. Step #12: Contact high-profile publications and interview shows on an individual and exclusive basis to gain the highest level of nationwide publicity. Offer to write ongoing columns for publications, and appear as a periodic guest on interview shows. You might offer to host your own legal, news-talk or interview show. Step #13: Compile a list of trade associations that serve the prospects you want to attract. Keep these trade groups on your mailing list. Offer to present seminars that are sponsored or co-sponsored by these trade associations, in hopes that they will mail seminar invitations to all of their members. Step #14: Compile a list of referral sources in the states you serve. Send them your packet of information so they understand what you do. Invite their referrals and offer referral fees, if appropriate. Keep these referral sources on your mailing list. Step #15: Compile a list of past clients. Send them a letter announcing your regional or national practice and a copy of your information packet. Most people have friends and colleagues in other states. Keep these past clients on your mailing list. Step #16: In all of your marketing materials, make sure you tell prospects the geographical area from which you accept clients. You might say something like: "Serving clients in the United States and Canada". Or, "I welcome inquiries from clients in (name the states)." If you don't mention the area you serve, prospects could easily conclude that you limit your services to your city or county. So be sure to tell prospects where you practice and put this information throughout your marketing materials. Step #17: Establish a web site. The easiest way to reach prospects in different states is to establish an Internet site. This puts your materials at everyone's fingertips 24 hours a day, whenever they want it. The more information you provide, the more likely you are to win a new client. So be generous with the information you post. Step #18: Market your seminars and speaking engagements nationwide. Make sure everyone on your mailing list knows you offer seminars. While they might not be the contact person, they can make your seminar known to the right people, who may get in touch with you. This is the most common way I receive invitations to speak to lawyers. Also, thanks to technology, now you can offer seminars over the telephone, by video conferencing, and over the internet. Step #19: If you can collect e-mail addresses from people on your mailing list, send an e-mail alert or briefing every week or two. The more often you stay in touch with everyone your mailing list (prospects, clients, past clients and referral sources), the more new clients you'll attract. After your law firm marketing efforts take root, and your publicity starts to appear, you'll get inquiries from prospective clients. Trade and professional associations will invite you to speak. And, one by one, you'll start getting clients from throughout the geographical area you wish to serve. Soon, you'll have a profitable, prestigious nationwide law practice, thanks to the energy you've invested in attorney marketing. TREY RYDER LLC Education-Based Marketing for Lawyers.
